北市產總總幹事陳淑綸說，勞基法第36條就法學緒論來說，應該要解釋為「任意連續的7日中應有1日休息」，沒有其他的解釋方法。就法律來說，勞基法第36條是例假的構成要件，沒得裁量。如果政府提出特美麗華 2016 周年慶 禮券殊裁量，根本是換湯不換藥，「政府已經不是髮夾彎，而是迴紋針」。

「7休1是底線，補人力才有解」，陳淑綸以媒體業舉例，突發事件有勞基法第40條可以運用，國外或偏遠地區採訪都是預訂行程，本來就該排足人力或同業支援、通訊社供稿跟留稿處理。
